1. General Provisions

1.1. The owner of the online store fonolukk.eu (hereinafter: the Online Store) is Smart Security OÜ (registry code: 10871730, +372 661 1774; email: info@fonolukk.eu).
1.2. These Terms govern the legal relationship arising between Smart Security OÜ (hereinafter: the Seller) and the person placing an order in the Online Store (hereinafter: the Buyer).
1.3. When goods are purchased by private individuals (hereinafter: the Consumer),
the provisions of the Law of Obligations Act of the Republic of Estonia (Võlaõigusseadus – VÕS) and the Consumer Protection Act (Tarbijakaitseseadus)
shall apply.

2. Prices and Placing an Order

2.1. All product prices displayed in the Online Store are in euros (€) and include applicable Value Added Tax (VAT / KM).
2.2. A delivery fee will be added to the price of the goods in accordance with the shipping method chosen by the Buyer during checkout.
2.3. The sales contract enters into force upon receipt of the total order amount in the Seller’s bank account or upon receipt of payment confirmation from the payment gateway provider (Montonio Finance OÜ).
2.4. If the ordered goods cannot be delivered due to being out of stock, the Seller will notify the Buyer as soon as possible and refund all payments received (including delivery costs) no later than within 14 days of notification.

3. Shipping and Delivery 

3.1. Goods are delivered throughout Estonia and to European Union countries via parcel lockers (Smartpost, Omniva, DPD), courier services, or via self-pickup from the Seller’s warehouse: Tallinn, Tuuliku tee 4 (on working days from 09:00 to 17:00).
3.2. Delivery time for in-stock items within Estonia is generally 1–3 business days.

4. 14-Day Right of Withdrawal (VÕS § 56)

4.1. A Buyer who is a Consumer (natural person) has the right to withdraw from the contract concluded in the Online Store within 14 days from the date of physical receipt of the goods.
4.2. The 14-day right of withdrawal does not apply to legal entities (OÜ, AS, KÜ, FIE, etc.).
4.3. In accordance with Section 56 (4) of the Law of Obligations Act (VÕS), during the 14-day period, the Buyer is entitled to inspect and test the goods only to the extent permitted in a physical retail store. The returned goods must not show signs of installation, soldering, wire stripping, or mechanical damage, and must be returned complete in their original packaging.
4.4. If the product has been used beyond what is necessary to ascertain its nature and characteristics, or if the product is damaged, the Buyer shall be liable for the reduction in the value of the goods (VÕS § 56 (4)). The Seller reserves the right to offset and deduct the amount corresponding to the decrease in value from the refund.
4.5. To return the goods, the Buyer must submit a withdrawal application in free form or a standard withdrawal form to the email address info@fonolukk.eu.
4.6. The Buyer must return the goods within 14 days of submitting the withdrawal application. The direct costs of returning the goods shall be borne by the Buyer (pursuant to VÕS § 56² (2)), unless the return is due to an incorrect or defective product sent by the Seller.
4.7. The Seller shall refund all payments received from the Buyer (including standard initial delivery costs) no later than within 14 days from receiving the withdrawal notice, but may withhold reimbursement until the goods have been received back or until the Buyer provides proof of shipment.

5. Right to File Claims and Warranty

5.1. Smart Security OÜ is liable for any non-compliance of the goods with the terms of the contract that becomes apparent within 2 (two) years from the date of delivery to the Consumer (VÕS § 218 (2)).
5.2. Upon discovering a defect, the Buyer must notify the Seller by email at info@fonolukk.eu no later than within 2 months of discovering the defect, specifying the invoice number and a description of the issue.
5.3. Smart Security OÜ is not liable for defects resulting from:

  • Improper installation or incorrect polarity connection to incompatible intercom lines;
  • Power voltage fluctuations or short circuits in the building's shared wiring network;
  • Mechanical damage and negligent handling.

6. Settlement of Disputes

6.1. All disputes shall primarily be resolved through negotiations. Complaints should be sent to info@fonolukk.eu.
6.2. If an agreement cannot be reached, the Consumer has the right to submit a petition for an out-of-court dispute resolution to the Consumer Disputes Committee (Tarbijavaidluste komisjon) operating under the Estonian Consumer Protection and Technical Regulatory Authority (TTJA) (address: Endla 10A, 10122 Tallinn, website: www.komisjon.ee) or use the EU Online Dispute Resolution (ODR) platform at ec.europa.eu/odr. Proceedings before the Consumer Disputes Committee are free of charge for consumers.
